Terms for Astrologers and Practitioners

These terms apply when you use Kundaly for professional purposes, either:
- as a practitioner, using Kundaly (for example on the Practitioner plan) to prepare readings for your own clients; or
- as an astrologer offering paid consultations to Kundaly users through Kundaly's marketplace.
They are an agreement between you and KUBIT SYSTEMS LIMITED, a company registered in England and Wales under company number 17477285, with its registered office at 128 City Road, London EC1V 2NX, United Kingdom ("we", "us"). They add to our Terms of Service and Privacy Policy. Where they conflict, these terms apply to your professional use.
By using Kundaly professionally, you confirm that you are acting in the course of your business and not as a consumer. If you accept these terms on behalf of a business, you confirm you have authority to bind it.
Part A — All professional users
1. Your clients' personal data
When you enter a client's details into Kundaly, such as their birth details, notes, events, questions or photographs, you are the controller of that data and we process it on your behalf as your processor. This section is the agreement between us that UK GDPR Article 28 (and the EU GDPR, where it applies) requires.
- Subject matter, nature and purpose: storing your clients' data and computing charts, readings and deliverables from it, so you can serve your clients. This lasts for as long as you keep the data in Kundaly.
- Types of data and data subjects: your clients' names, birth dates, times and places, contact details you choose to add, notes, life events, questions, and any photographs you upload. Some of this may reveal religious or philosophical beliefs, or health information.
- Your responsibilities: you have a lawful basis, and where needed your client's explicit consent, for entering their data, including any special-category data. You give your clients the privacy information the law requires, and you only enter what you need.
Our responsibilities. We will:
- process the data only on your documented instructions — these terms and the way you use Kundaly's features — unless the law requires otherwise, in which case we will tell you unless the law forbids it;
- make sure the people who process it are bound by confidentiality;
- protect it with appropriate technical and organisational security measures;
- help you respond to your clients' requests to exercise their rights, using Kundaly's export and deletion tools and reasonable further help;
- tell you without undue delay after we become aware of a personal data breach affecting your clients' data, and help you meet your own obligations about it;
- help you, where reasonable, with data protection impact assessments and consultations with regulators;
- delete the data when you delete it or close your account, unless the law requires us to keep it; and
- make available the information you reasonably need to show that we comply with this section, and allow a reasonable audit or inspection — at your cost, on 30 days' notice, no more than once a year, and subject to confidentiality.
Other terms:
- Sub-processors. You authorise us to use the service providers listed in our Privacy Policy, such as hosting, AI model and messaging providers. We bind each one to data protection terms that are no less protective than these, and we remain responsible for them. We will update that list before adding or replacing one. If you object on reasonable data protection grounds, you may stop using Kundaly for that data.
- International transfers. Where a sub-processor processes data outside the UK, we rely on the safeguards the law requires (such as adequacy regulations or the UK International Data Transfer Agreement or Addendum).
What a client tells an astrologer in a marketplace consultation is covered by section 11 instead.
2. Professional standards
When you use Kundaly professionally, you must:
- present astrology and related traditions honestly, as guidance and reflection — never as certain prediction, and never with a guarantee of any outcome;
- never give medical, psychological, legal, financial or investment advice. Never tell anyone to stop or avoid medical treatment, and refer people to qualified professionals or emergency services when they need them;
- never predict or imply the date, age or timing of anyone's death, serious illness or accident;
- never use fear, guilt or pressure to sell anything, including remedies, rituals, pūjās or gemstones. Never claim a curse, "black magic", evil eye or bad influence that only a paid service can remove;
- never claim that a remedy, mantra, amulet or gemstone cures, treats or prevents any disease or condition;
- take particular care with people who may be vulnerable, for example because of grief, illness, distress or age;
- describe your qualifications and experience truthfully; and
- comply with the laws that apply to your services, including consumer protection, advertising, data protection and tax laws in the places where you and your clients are.
3. Your responsibility for your services
You alone are responsible for the readings, advice and services you provide to your clients and to Kundaly users, and for any decisions about which parts of Kundaly's output to use or pass on. Kundaly's calculations and AI-written text are tools for you to check and interpret. They are not advice from us to your clients.
4. Indemnity
You will compensate us for any loss, damage, costs (including reasonable legal costs) or liability we incur because of a claim by a third party (including your clients, Kundaly users or a regulator) arising from:
- your services or advice;
- your breach of these terms; or
- your processing of personal data in breach of data protection law.
We will tell you promptly about any such claim and let you take part in its defence at your cost.
5. Our liability to you
- We do not exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to exclude or limit.
- Apart from that, we are not liable, whether in contract, tort (including negligence) or otherwise, for any loss of profits, revenue, business, contracts, goodwill or anticipated savings, or for any indirect or consequential loss.
- Our total liability to you in any 12-month period is limited to the greater of: the fees you paid us in the preceding 12 months (for practitioners), or the fees we retained from your consultations in the preceding 12 months (for astrologers); or £100.
- Kundaly is provided as it is. Except as these terms expressly say, all warranties, conditions and other terms implied by statute or common law are excluded, as far as the law allows.
Part B — Astrologers in the marketplace
6. Joining and staying listed
- You must give us accurate information about yourself, complete the checks we ask for, and keep your profile, qualifications, prices and availability up to date.
- We decide who is listed, how listings are ranked and shown (including featured or boosted placements), and we may decline, pause or remove a listing. Where it is reasonable, we will tell you why and give you a chance to respond, except where the law, safety or a serious breach of these terms requires us to act immediately.
7. Your independence
You are an independent professional, not our employee, worker, agent or partner. You decide how you provide your consultations, within these terms. Nothing in these terms creates employment or partnership, and you are responsible for your own tax, national insurance or social security, registrations and insurance.
8. Your agreement with users
Each consultation is an agreement between you and the user. You are responsible for providing it as described and with reasonable care and skill, and you must meet the obligations consumer law places on you as a trader. Your cancellation terms must be shown before the user books, and must be fair. If you cancel a booking or do not attend, the user receives a full refund, and we may deduct it from your payouts.
9. Payments, commission and payouts
- We collect payments as your agent. You appoint us as your limited agent to collect payments from users for your consultations. When a user pays us, their payment to you is complete, whether or not we have paid it out to you yet.
- Payouts. We pay you through our payment partner (currently Razorpay Route) into the account you link, after deducting our commission at the rate shown to you when you join (or as later changed under section 13), any refunds or chargebacks for your consultations, and any amounts the law requires us to withhold. Your payout is subject to our payment partner's own terms and checks.
- Taxes. You are responsible for your own taxes on what you earn. Where the law requires, we may report your earnings to the authorities, or withhold amounts from your payouts.
- Chargebacks and disputes. If a user disputes a payment for your consultation and the dispute succeeds, the amount, and any fee charged to us, may be deducted from your payouts.
10. Reviews and fair dealing
- Users may rate and review your consultations. You must not write or commission fake reviews, offer anything in return for a positive review, or pressure anyone over a review. We may remove reviews that are fake, abusive or unlawful.
- You must not use a booking made through Kundaly to move that user to paying you outside Kundaly for consultations they found through Kundaly.
11. Users' personal data
You receive a user's personal data, such as their name, birth details, questions and the messages in the consultation room, only to provide the consultation. You must keep it confidential and secure. Use it only for that consultation and any follow-up the user asks for. Never use it for marketing without the user's consent, and delete it when you no longer need it. For what you do with that data, you are a separate controller, responsible for your own compliance with data protection law.
Messages in the consultation room are stored by Kundaly. We may review them to investigate a complaint, a safety concern or a payment dispute.
12. Ending your listing
You may stop offering consultations at any time, after completing or cancelling (with full refunds) any bookings already made. When a listing ends, we pay out what you are owed, less any refunds, chargebacks or amounts we are entitled to deduct. We may hold a payout for as long as reasonably necessary to deal with an open complaint, refund, chargeback or investigation.
Part C — General
13. Changes
We may change these terms, including our commission, by giving you at least 30 days' notice. Changes needed for legal or security reasons may apply sooner. If you don't accept a change, you may stop using Kundaly professionally before it takes effect.
14. Law and courts
These terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes), are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
